Court Mediation (Required/Requested)
Court mediation is the term used when mediation is ordered by a judge. A judge will often order that mediation be attempted but ALL agreements written in mediation or signed in mediation are voluntary. Participants are encouraged to engage in the process with honesty, transparency and an open mind. Although court ordered mediation originates with a court order, it serves as an opportunity to have a creative role in finding unique solutions that are self-determined by the parties. If no or only a partial agreement is reached, the parties are free to pursue other routes to resolving their disputes such as scheduling a hearing with a judge who would then rule or hiring representation by an attorney to negotiate on your behalf.
